9 conditions to do Nakal Kafala with Huroob without Kafeel’s Permission:

1. Iqama can be transferred to a new employer if Kafeel does not provide Iqama within the 3 months of arrival in KSA.

2. After 3 days of the Iqama expiry and work permit, Iqama can be transferred to another sponsor.

• and type your border number, and hit search.

3. If the employer has not paid the salary for 3 months.

4. The employer is listed in the Red Nitaqat and about 75% of the total employees’ contracts are not registered with GOSI.

5. The employer is in the Red Nitaqat as they pay fewer salaries to 80% of employees under the wage protection system and the salaries are also delayed.

6. The employment contract has ended.

7. The tasattur (or cover-up) was reported to your organization.

8. If the court has made the decision to favor the ex-pat allowing him to transfer his sponsorship.

9. Before the contract is completed:

• The employee arrived in KSA 12 months ago.
• A 3 months notice was provided for the job transfer,
• The contract was terminated under Article 77 (unfair or unlawful termination of the contract).

Conditions Eligible to Transfer Iqama without Kafeel’s Consent

If you met any of the above-mentioned 1,2,3,4,5 conditions, Transfering Nakal Kafala with Huroob is very easy. Just follow these steps:

• An employee transfer request will be created by the new Kafeel through Qiwa: https://auth.qiwa.sa/en/sign-in
• The transfer request will be forwarded to and accepted by the ministry of labor.
• To check the Iqama transfer status visit: https://bit.ly/3ylD9Xf
• You have to pay the Iqama transfer fee once your request is accepted in MOL.
• Now to check the Iqama transfer status from Absher by visiting: https://www.absher.sa/
• Go to dashboard>Details and then click other information. In the end, you will see Kafeel’s name. If it’s still showing old Kafeel’s name then it means your application is still in progress.
• Once it starts showing the new sponsor’s name, visit any Jawazat center to print your new Iqama.

In case the online procedure is not successful ask your new sponsor to visit the Labor Office and complete the whole procedure without old Kafeel’s approval.

Conditions Eligible to do Nakal Kafalawith Huroob Through Court Ruling:

If you met any of the above-mentioned 6,7,8,9 conditions, transferring Nakal Kafala with Huroob is possible, if the court has made the decision to favor the ex-pat. Just follow these steps:

• The new Kafeel will go to the Labor Office along with the needed documents.
• The Maktab Amal officer will examine the court ruling and other documents and then transfer the Nakal Kafala to new sponsorship in the MOL system.

• Pay the Iqama transfer fee once your request is accepted in MOL.
• Now to check the Iqama transfer status from Absher by visiting: https://www.absher.sa/ Go to dashboard>Details and then click other information. In the end, you will see Kafeel’s name. If it’s still showing old Kafeel’s name then it means your application is still in progress.
• Visit any Jawazat center to print your new Iqama.

• Current Iqama of the expatriate employee.
• A valid passport copy of the expatriate employee.
• The court ruling or decision in the favor of the ex-pat.
